Investment Law Round Table Discussion with Representative of the EU Commission

With the support of the JAA Investment Treaty Arbitration Committee, Nishimura & Asahi will host a round table discussion with a representative of the EU Commission, at its Tokyo Office on January 31, 2019. André von Walter, Legal Counsel and Negotiator in the Directorate General for Trade of the European Commission, will provide the EU Commission’s views on the most recent developments in Investor-State Dispute Settlement (ISDS), in particular, (i) the judgment of the Court of Justice of the European Union (the CJEU) in the Achmea Case*, (ii) its impact on ongoing and future ISDS, and (iii) the establishment of a Multilateral Investment Court. Lars Markert will moderate the debate.

* About the case Achmea B.V. v. The Slovak Republic, UNCITRAL, PCA Case No. 2008-13: On March 6, 2018, the Grand Chamber of the CJEU held that the ISDS clause in the Netherlands-Slovakia Bilateral Investment Treaty, and by extension ISDS clauses in bilateral investment treaties between Member States of the EU, are incompatible with EU law. Following this judgment, on October 31, 2018, the German Federal Supreme Court set aside the final award in the Achmea case (in doing so also referring to Lars Markert’s PhD thesis on investment law).
