Derivatives
We provide a wide range of advice in the derivatives space, such as on ISDA and other industry standard documentation, as well as analysis of derivatives regulations under the Financial Instruments and Exchange Act and the Commodity Derivatives Transaction Act.
ISDA and Other Industry Standard Documentation
We regularly provide advice concerning ISDA Master Agreements and VM/IM CSAs. We also handle issuance of bespoke netting/collateral opinions and have experience providing advice on master agreements in repurchase/securities lending transactions (GMRA/GMSLA).
Regulatory Analysis
We provide extensive Japanese law advice in relation to the financial instrument derivatives regulations under the Financial Instruments and Exchange Act and the commodity derivatives (including those related to electricity) regulations under the Commodity Derivatives Transaction Act. We also handle foreign law matters by utilizing our global office network.
New Product Development/Market Trend Matters
We are actively involved in supporting product development of new derivatives whose underlying assets are not traditional and in responding to market trend matters.
Litigation/Crisis Management concerning Derivatives
We have handled litigation and crisis management matters concerning derivatives in cooperation with the other professional practice groups within our firm.
Seminars
Among the derivatives team members, one has been involved in furthering industry development by serving as a speaker at numerous conferences held by ISDA.
