On 21 November 2024, the National Assembly passed amendments to the Law on Pharmacy (“New Law”) that aim to address certain gaps in the current legal framework, and to advance transparency as well as investment in the pharmaceutical sector. In this article, we will review certain aspects of the New Law that may be of interest to foreign investors. In Vietnam, strict restrictions prohibit foreign-invested enterprises (FIEs) from engaging in both pharmaceutical distribution and other activities deemed relevant to pharmaceutical distribution. The current regulation defines these activities broadly, including preservation transportation, and the receipt of orders and payments. Only pharmaceuticals and pharmaceutical ingredients manufactured by FIEs in Vietnam are expressly exempt from prohibition.
