Department of Intellectual Property (“DIP”) Introduces Notification on Examination of First Fast-Track Process for Trademark Registration, as a Special Case, During New Year Festival 2026
On 15 December 2025, the DIP released a notification introducing a special fast-track examination process for Thai applicants filing for trademark registrations during the New Year Festival period in 2026 (15 December 2025 to 31 January 2026). The notification was issued to promote business and reduce obstacles for entrepreneurs, making it more convenient for them to engage in business.
The special fast-track trademark registration will ensure examination of trademark applications within three months of the filing dates. To be eligible for the fast-track process, the trademark application must comply with the following conditions:
- 1) The trademark application must be submitted via the DIP’s e-filing system, with the intent to obtain notice of the results of the trademark registration examination as a special case during the New Year Festival 2026.
- 2) The application is limited to one class and may contain up to five (5) goods or services.
- 3) The specifications of goods/services all conform to those recommended in the sample acceptable specifications issued by the DIP.
- 4) All required documents must be submitted along with the application.
- 5) The application must not contain any amendments (such as change of name and address), recordation of assignments or inheritances, or requests to prove acquired distinctiveness through use.
- 6) The applicant must submit a search report for similar and/or identical prior marks, based on search results from the DIP database, the TM View, and the Global Brand database.
The notification applies only to trademarks and service marks, and excludes combinations of color marks, shape or form of object marks, sound marks, certification marks, and collective marks. It also does not apply to trademark applications filed under the Madrid system.
During examination of applications for trademark registration pursuant to this notification, the Trademark Registrar may need to revoke the publication order or cancel the registration if another party later files an application claiming a filing date of the application outside Thailand as the first filing date, or that the date the goods bearing the trademark were exhibited at an international trade fair, as the filing date in Thailand, according to Section 28 and Section 28 Bis of the Trademark Act B.E. 2534 (1991). This also applies to applications for registration of an international trademark, seeking protection in Thailand, that previously were filed for registration. Applicants (trademark proprietors) will be deemed to be aware of and have consented to these actions. In the event of any damages, applicants cannot request compensation or restitution from the Thai government or the DIP.
This special fast-track examination offers significant value for new trademark filings, particularly for businesses launching in early 2026. Applicants can secure preliminary trademark protection in an expeditious manner, establishing foundational rights for their core goods or services. Businesses can file additional applications to expand coverage across supplementary goods, services, or classes, thereby building comprehensive trademark protection that aligns with business growth and long-term IP strategy.
