Vietnam: Notable Implications of Decree 148 on The Law on Land

Since the effective date of the Law on Land 2013 (1 July 2014), Vietnamese authorities have issued 13 decrees and 48 circulars and joint circulars for the purpose of enhancing its practical implementation. However, after more than six years, many difficult issues remain unresolved.In an effort to overcome such obstacles, the government of Vietnam recently issued Decree No. 148/2020/ND-CP dated 18 December 2020 (Amendments and Supplements to Several Decrees, Providing Detailed Regulations on Implementation of the Law on Land) (“Decree 148”), which came into effect on 8 February 2021.  We discuss below some notable points of Decree 148. Mr. Bang is a partner of our firm, with more than 15 years of experience as a lawyer. Mr. Loc joined Nishimura & Asahi (Ho Chi Minh City Office) in July 2012. Before that, he spent more than 8 years with other foreign and domestic law firms in Vietnam. He has assisted clients in many large-scale cases including, among others, an acquisition of shares in a public pharmaceutical company in Vietnam, transactions acquiring shares in a public construction company, an acquisition of shares in a digital retailer listed in Vietnam, and bidding by a client for development of a real estate project in Ho Chi Minh City. Mr. Loc has assisted many well-known Japanese investors in investments worth hundreds of millions of US dollars in finance leasing, real estate development, and steel manufacturing businesses in Vietnam. He has advised a number of giant Japanese companies in conducting their business in Vietnam, and he has given lectures to clients’ employees in relation to anti-corruption matters. He has also advised clients in carrying out product recall procedures in Vietnam. Cao Tran Nghia has substantial experience as both in-house and outside counsel, and has worked at a leading law firm and a multinational investment fund in Vietnam. He joined Nishimura & Asahi in 2013, and since joining our firm, has provided legal advice to numerous domestic and multinational clients, including Vietnamese and Japanese corporations, with a focus on M&A, Real Estate, Construction, Infrastructure and PPP, and Energy in Vietnam.
